Terms and Conditions – Aluvien (EU + US compliant)

These Terms and Conditions ("Terms") apply when you place an order with Aluvien ("Aluvien", "we", "our" or "us") for products sold via our website ("Products"). By placing an order, you agree to these Terms.

Please read these Terms carefully. If you do not agree with them or have any questions, please contact our customer service before placing an order.

Article 1 – Definitions

  • Consumer: a natural person who is not acting for purposes related to trade, business, craft, or profession.

  • Cooling-off period: the 14-day period during which the consumer may exercise the right of withdrawal (EU only).

  • Right of withdrawal: the option to cancel the distance contract within the cooling-off period (EU only).

  • Distance contract: a contract concluded through our website without physical presence.

  • Durable medium: any tool (e.g., email) that enables you to store information for future reference.

Article 3 – Applicability

These Terms apply to every offer from Aluvien and every distance contract concluded between us and the consumer.

The text of these Terms will be made available to the consumer prior to or during the order process. If this is not possible, they can always be requested free of charge.

Article 4 – The Offer

  • Product descriptions are provided clearly and truthfully.

  • Images are for illustration purposes only; packaging and colors may differ from what is displayed on your device.

  • Obvious mistakes or typographical errors do not bind us.

Article 5 – The Contract

  • The contract is concluded when you place an order and we confirm it.

  • You will receive an order confirmation via email.

  • Until we confirm receipt of your order, you may cancel it.

Article 6 – Right of Withdrawal (EU consumers only)

  • EU consumers have a statutory cooling-off period of 14 days to cancel their order without giving reasons.

  • The cooling-off period starts on the day after you (or a person designated by you) receive the product.

  • Products sealed for hygiene reasons cannot be returned once opened.

Article 7 – Returns

  • To exercise your right of withdrawal, notify us by email or by using the standard withdrawal form (EU consumers only).

  • You must return the product as soon as possible and no later than 14 days after notifying us.

  • You are responsible for return shipping costs unless otherwise stated.

Article 8 – Our Obligations for Withdrawal

  • Once we receive the return, or you provide proof of shipment, we will refund your payment within 14 days.

  • Refunds will be made using the same payment method you used, unless agreed otherwise.

Article 9 – Exclusion of the Right of Withdrawal

The right of withdrawal does not apply to:

  • Opened or unsealed products that are not suitable for return for health or hygiene reasons.

  • Products made to your specifications or personalized.

Article 10 – Prices and Payment

  • All prices are inclusive of VAT (where applicable) and exclusive of shipping costs (unless stated otherwise).

  • Payment must be made using the payment methods offered on our website.

  • We reserve the right to correct or cancel an order in case of pricing errors.

Article 11 – Delivery

  • Orders are shipped to the address provided by you.

  • We aim to deliver within the stated timeframes; if this is not possible, we will notify you.

  • The risk of damage or loss passes to you once the order is delivered.

Article 12 – Warranty and Conformity

  • Our products comply with the contract and product specifications as stated on our website.

  • Statutory warranty rights apply for EU consumers.

Article 13 – Health, Use and Disclaimer

  • Cosmetic purpose only: Aluvien products are intended for external cosmetic use only.

  • No medical claims: Our products are not medicines. They are not intended to diagnose, treat, cure, or prevent any disease.

  • FDA notice (US): Statements regarding our products have not been evaluated by the Food and Drug Administration (FDA).

  • Individual results: Results may vary from person to person. No guarantees are made regarding effectiveness or outcomes.

  • Allergies: Consumers are responsible for reviewing the ingredients list and determining if a product is suitable for their skin.

  • Patch test recommended: In case of allergies or sensitive skin, perform a patch test before full use or consult a doctor/dermatologist.

  • Proper use: Use products only as directed. Avoid contact with eyes. Discontinue use if irritation occurs.

  • Liability: Aluvien is not liable for damage (direct or indirect) resulting from misuse, use contrary to instructions, or ignoring allergy/ingredient information. To the extent permitted by law, we exclude liability for consequential damages, indirect damages, or subjective claims regarding product effectiveness.

Article 14 – Complaints

  • If you have a complaint, contact us at support@aluvien.com.

  • We aim to respond within 14 days with a substantive reply.

Article 15 – Disputes

  • For EU consumers: these Terms are governed exclusively by Dutch law. Any disputes will be submitted to the competent court in the Netherlands.

  • For US consumers: these Terms are governed by the laws of the State of [Insert State, e.g., Delaware or New York if registered there], without regard to conflict-of-law principles. Any disputes shall be handled exclusively in the courts of that state.
